Sony is totally in the right on this one. They had a contract.

The more I think about it, the more I wonder if Sony really had their ass covered or not. Tt will all depend on what's written in the contract, but Sony's response makes me wonder if they screwed up. They keep saying the "Kevin Butler character" in their press release, but the problem was he was never introduced as Kevin Butler in the commercial. When it comes down to advertising and the use of an actor playing similar parts there's actually lots of precedence out there that favors the actor every time. If Sony discontinued the Kevin Butler character in their ads they may not have much of a leg to stand on. If it comes down to the details of the actor's non-compete, which are notoriously difficult to enforce in court, it may end up getting thrown out. Regardless though, I have a feeling this will just get settled out of court and as of next week we'll never hear about this again.
Though the fun thing will be to bet whether or not Kevin Butler shows up again.
Yeah, he wasn't playing the Kevin Butler character, nor was he advertising the Wii directly. He was in a tire commercial, which happened to have a promotion for a free Wii console. I think Sony is a bit out of line here.
